After the voters strongly approved the establishment of urban growth boundaries last November, the next County Council chickened out. Although some members had expressed their support of URBs prior to the election, once they were on the Council they said the matter needed more study. The lengthy study by the “Smart Growth” committee makes some minor changes but relies of the cooperation of all parties involved. As you know, such cooperation is virtually impossible to attain. The Charter Review Commission has a great opportunity to stop urban sprawl by putting urban growth boundaries back on the ballot next year. I wish you well.

In response to the committee’s request, I submit the following recommendation for a change in the Volusia County Charter.

The position of the Chairman of the County Council should be strengthened to give the chairman greater bargaining power to accomplish his leadership agenda. That strengthening should not intrude on the county manager’s authority.

The veto power is the one grant of authority that strengthens the chairman without affecting the county manager. The last county charter committee recommended this action but the county council chose not to submit it to the voters.

Examples of the veto power include but are not limited to the following:

  • Ordinances that include zoning or land use development where environmental, water recharge, open space, transportation, or habitat issues need more attention.

  • Ordinances that force county spending that should be reconsidered in light of the chairman’s priorities or agenda.

  • Ordinances that adopt or change the budget where pork-barrel spending by the county council in their respective districts should be reconsidered.           

History shows that the veto power is not often used. It has been my experience that the simple existence of the veto possibility gives the chairman added leverage thereby giving credence to the word chairman.

The chairman’s veto should be over-ridden by a super majority vote of the county council.

Volusia has a different county council for this charter committee report and hopefully a different result could occur which would empower our chairman to achieve his agenda.
