Florida Wildlife Conservation Commission's gopher tortoise draft  management plan has been adopted, as well as the approval of listing the species as Threatened by the FWC Commissioners on September 12, 2007 . This is of course not the end of a process but the beginning of the plan implementation that FWC intends to progress rapidly.  We anticipate that stakeholders will continue to have an important role as the plan is implemented.

For clarity, the gopher being listed as a threatened species is not official until the rule amendment becomes effective, which is anticipated to be Thursday, November 8th at the earliest. 

The amendments to 68A-27.004 (adding the GT to the threatened list) and an amendment to 68A-27.005 (removing the GT from the SSC list) become official after the rule amendments are reflected in the Florida Administrative Code, which is published by the FL Department of State. 

This rule change has been complicated by the Commission's decision to postpone action on the manatee.  Since the proposed rule amendment for 68A-27.004 related to both gophers and manatees, a notice of change will need to be advertised reflecting the elimination of the manatee language from the proposed rule amendment.  The rule amendment can then be filed for adoption 21 days after that notice is published.  The rule amendments would be effective 20 days after it's filed.  

Based on the next opportunity to publish a notice of change (Fri. Sept. 28th), the required 21 day delay in filing the rule for adoption, and  the required 20 day delay in the rule becoming effective - barring any further complications, the gopher listing will be official on Thursday, November 8th.
