Amendment Cycle 09-2
Volusia
County has initiated the amendment cycle for 09-2 which is the second
large-scale amendment cycle for the year 2009. The following is a list
of each of the amendments associated with this amendment cycle. A link
is provided to the staff report for each amendment in the following

- CPA 09-2-1: Lake Beresford
Conservation Area
A Future Land Use Map amendment to change the future land use
designation on approximately 76.9 acres from Rural to Conservation. The
County purchased the property in November, 2008 with Volusia Forever
Funds for conservation purposes. It is 100 percent County owned. The
property is managed as part of Lake Beresford Park.
- CPA 09-2-2: Heart Island Conservation Area
A Future
Land Use Map amendment to change the future land use designation on
approximately 1040 acres from Forestry Resource and Environmental
Systems Corridor to Conservation. The County and SJRWMD purchased the
property in December, 2008 for conservation purposes. The property is
adjacent to the existing Heart Island Conservation Area. The Counties
portion was purchased using Volusia Forever Funds. The property is
managed as part of the Heart Island Conservation Area.
- CPA 09-2-3: Doris Leeper Spruce Creek Conservation
Area
A Future Land Use Map amendment to change the future land use
designation on approximately 58.03 acres from Rural and Environmental
Systems Corridor to Conservation. The County and SJRWMD purchased the
property in September, 2008, for conservation purposes. The County’s
portion was purchased with Volusia Forever funds. The property is
adjacent and a part of other conservation properties to the north and
east, cohesively managed as the Doris Leeper Spruce Creek Preserve.
CPA 09-2-4: Deland Area Enclave

A Future Land Use Map
amendment to change the future land use designation on approximately
25.89 acres from Rural to Urban Low Intensity. This is a pocket of
unincorporated lands surrounded by Deland. It is comprised of 59 lots
almost fully developed with an inconsistent R-3 zoning designation.
Because the area is already developed in accordance with the zoning
designation, staff believes it is likely a mapping error. A future land
use map amendment is needed to change the future land use designation to
match the zoning and existing development from Rural to Urban Low
Intensity.
CPA 09-2-5: Green House Gas Requirements

On July 1, 2008, HB 697 became
effective, requiring all local governments to comply with new
“Greenhouse Gas Reduction Requirements”. The purpose is to reduce
greenhouse gas emissions statewide. In accordance with this new law,
staff proposes a text amendment to the Comprehensive Plan to amend
Chapter 2,Transportation Element and Chapter 12, Conservation Element to
incorporate new Green House Gas reduction strategies, and to include an
Energy Conservation Area map in the Future Land Use Map Series contained
in Appendix 1, Maps and Figures.
CPA 09-2-6: Port Orange Wellfield Area Expansion

amendment on approximately 71.8 acres from Environmental Systems
Corridor to Conservation. This amendment is intended to comply with
provisions of an interlocal agreement between Port Orange and the County
that was executed in October, 2008.
CPA 09-2-7: River of Lakes Corridor Scenic Highway and
Heritage Crossroads:

The County Council adopted Resolutions of Support for both scenic
highways in 2008. Resolution no. 2008-158 on September 18, 2008 for
River of Lakes, and Resolution no 2008-191 on November 13, 2008 for
Heritage Crossroads. In order for the corridor management entities (CMEs)
to participate in grant opportunities the CME must prove further
evidence of local government support. Therefore, the County is proposing
to include the highways in our Comprehensive Plan through a text
amendment to the Chapter 2, Transportation Element, policy 2.3.3.3, and
a map amendment to Figure 2-8 Scenic Corridors 2025 map.
CPA 09-2-8: Thoroughfare System 2025 Map Amendment

A map amendment to remove
certain roadways that do not meet the thoroughfare criteria from the
thoroughfare roadway system. Tindale-Oliver was contracted to study the
thoroughfare system and found several roads that function as rural,
local roads rather than thoroughfares. These roads are very unlikely to
require improvement or capacity expansion in the foreseeable future. A
comprehensive plan change to amend figure 2-1 is required to remove them
from the Thoroughfare Roadway map. 15 roads are proposed to be removed
from the system.
CPA 09-2-9: Agriculture Family Subdivision

Comprehensive Plan policy
1.4.1.8 allows farmers to subdivide their property for family member.
The current policy allows 10 lots on 20 acres. VCOG Smart Growth
Committee recommends that this policy be revised to discourage
unintended sprawl and more easily allow true family splits. The proposed
policy allows 3 lots on 25 acres. The proposed lot size would be
determined during subdivision approval process rather than the current
mechanism of special exception.
CPA 09-2-10: Farmton Local Plan
Future land use map amendment
of 47,000 acres located south of Edgewater and west of I-95 to Brevard
County line. The amendment proposes two new land use designations called
GreenKey and Sustainable Development Area (SDA). The amendment proposes
a revision to the ECO map to include an additional 21,000 acres. The
amendment proposes a spine transportation network. The amendment
includes a goal and eight objectives with their associated policies.
