Q. Who do I contact to find out how to develop my property?

Q. How do I subdivide my property?
A. You first must contact Zoning to determine the minimum lot size required based on the properties current zoning classification. Divisions of property into 10 acres or greater may be exempt from the subdivision regulations provided the property is not zoned Resource Corridor (which requires a minimum lot size of 25 acres) or Forestry Resource (which requires a minimum lot size of 20 acres). Divisions of property into 2.5 acre lots may be approved on an exception basis. A Subdivision Exemption application must be submitted to the Land Development Office for review, and a determination must be made regarding whether the following criteria are met:

  • There are no more than four new lots.
  • The division does not represent a multiple division of contiguous lands by the same owner.
  •  Each lot must contain at least 10,000-square-feet of contiguous buildable area above the 100-year flood-prone level.
  • There will be no new public streets.
  • The current year's taxes must be paid.

Divisions of property into less than 2.5 acre lots are required to go through the formal subdivision review process ultimately resulting in a recorded plat. The process usually takes approximately six months. Contact Land Development for specifics regarding your property.

Q. What if I want to sell part of my property to my neighbor?
A. Volusia County has a process for review of an  Adjustment of Lots of Record application. The application is reviewed for compliance with Zoning's minimum lot size, verification that the original parcels have legal standing status, and verification that there are no platted easements which would be affected by the adjustment.

Q. How do I obtain a driveway permit or a permit for any work in a County right-of-way?
A. Land Development has a process for review of a Use Permit application that takes less than seven (7) working days. To determine the applicable review fee, see Page 4 of the Fee Schedule below.

Q. How do I find out if my street is County maintained?
A. To find out if your street is County maintained and would require a Volusia County Use Permit, contact the  Volusia County Right-of-Way Department:

Q. What are the specifications for my residential driveway?
A. - The minimum width at the right-of-way line is ten (10) feet and the maximum is twenty four (24) feet.
- The driveway width shall flare an additional minimum five (5) feet starting at a point a minimum of eight (8) feet from the edge of the traveled way.
- The driveway shall be a minimum thickness of four (4) inches with reinforcement steel or wire mesh or a minimum of six (6) inches thickness without reinforcement.
- Driveways are required to be asphalt or concrete within the public right-of-way along all existing paved roadways.
- An unpaved driveway to a dirt County maintained road shall be a minimum thickness of six (6) inches of stabilized material.
- No driveway shall be located closer than five (5) feet from an adjacent property line.

Q. What is the process for developing a commercial site?
A. Volusia County has a Site Plan Review Process which typically takes two to three months to complete. Each site is evaluated for road access, parking, stormwater, landscaping, tree retention/replacement, utilities, environmental concerns, buffers, vehicular circulation and other matters. The review fee varies for each development. Contact Land Development to discuss the specifics of your site.

Q. How can I find out if my project is feasible without spending a lot of money up front on engineering?
A. The Technical Review Staff meetings are held twice a month and are free to the public. These meetings are on a first-come, first-served basis. Anyone may attend and discuss their proposed project with the staff. It is very helpful for the staff to receive copies of the proposed project with a location map a week in advance of the meeting so that staff can review and visit the site.  Copies of the proposed project and location map should be submitted to the Land Development Office for distribution to the staff.
